By accessing, browsing, or making purchases through the GOKAMI Vault website and services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Service. Your continued use of the Service following any changes to these Terms constitutes acceptance of those changes.

2.1 No Account Required

GOKAMI operates on a guest checkout system. You can purchase digital artwork without creating an account. We only collect the minimum information necessary to process your transaction and deliver your files.

2.2 Sales Channels

GOKAMI offers different purchasing channels depending on the artwork type:

• Live Drops: Exclusively available on Etsy. All new releases and limited edition drops are sold through our Etsy storefront.
• Music & Albums: Available through secure PayPal, credit card, and other payment systems on gokamiart.com.
• Vaulted Art: Premium pieces available only on request. Contact us directly for inquiries about vaulted artwork.

2.3 Pricing

All prices are displayed in Euros (€) and are subject to change without notice. The price applicable to your purchase will be the price displayed at the time of your order confirmation.

2.4 Payment

We accept various payment methods depending on the sales channel:

• Etsy (Live Drops): All payment methods accepted by Etsy including credit/debit cards, PayPal, and Etsy gift cards
• Direct Purchase (Music/Albums): PayPal, credit cards, and other secure payment processors
• Vaulted Art: Payment arrangements discussed upon request - secure invoice and payment options provided

By providing payment information, you represent and warrant that:

• You are authorized to use the payment method
• The information you provide is accurate and complete
• You will pay all charges incurred
• You are at least 18 years of age

2.5 Transaction Processing

All transactions are processed through secure, encrypted payment gateways (Etsy, PayPal, Stripe, or other trusted processors). Payment must be received and cleared before digital files are delivered. We reserve the right to refuse or cancel any order for any reason.

2.6 Taxes

You are responsible for any applicable taxes in your jurisdiction. Prices displayed do not include applicable sales tax, VAT, or other local taxes unless specifically stated.

2.7 Delivery

Digital files are delivered via email or through the platform's download system (Etsy for Live Drops) immediately upon payment confirmation. For vaulted art purchases by request, delivery methods will be confirmed during the purchase process. Please ensure your email address is correct at checkout.

3.1 Ownership

All digital artworks, designs, text, graphics, logos, and other content on the Service are the intellectual property of GOKAMI or its content creators and are protected by international copyright laws.

3.2 Limited License

When you purchase digital artwork, you receive a limited, non-exclusive, non-transferable license to use the artwork as specified in our Digital Rights & Licensing terms. You do not acquire ownership of the copyright or any other intellectual property rights.

3.3 Trademarks

GOKAMI, the GOKAMI logo, and all related names, logos, and slogans are trademarks or registered trademarks of GOKAMI. You may not use these trademarks without our prior written permission.

3.4 Spiritual Content

All artwork contains spiritual testimony and is created with intentional meaning. While you may use the artwork according to your license, the spiritual essence and testimony embedded within each piece remain the intellectual and spiritual property of GOKAMI.

Your license to use purchased artwork is subject to the terms outlined in our Digital Rights & Licensing page. In summary:

• Personal display and enjoyment
• Social media sharing with attribution
• Personal prints for non-commercial use
• Digital wallpapers and backgrounds
• Portfolio use with attribution
• Spiritual meditation and contemplation

4.2 Prohibited Uses

• Commercial reproduction or resale
• Creating derivative works without permission
• Merchandise production for sale
• Logo or branding use
• NFT minting or blockchain tokenization
• Sublicensing to third parties
• Removal of spiritual attribution or testimony

You agree not to use the Service for any unlawful purpose or in any way that violates these Terms. Prohibited activities include but are not limited to:

• Violating any applicable laws or regulations
• Infringing on intellectual property rights
• Transmitting viruses, malware, or harmful code
• Attempting to gain unauthorized access to our systems
• Harassing, threatening, or defaming others
• Using automated systems (bots) without permission
• Engaging in fraudulent activities
• Reselling, redistributing, or sharing purchased files
• Using artwork in ways that contradict its spiritual testimony

6.1 Digital Goods - No Refunds

GOKAMI does not offer refunds for any digital downloads. Due to the nature of digital goods, all sales are final once files have been delivered. When you complete your purchase, you receive immediate access to digital files that cannot be "returned."

6.2 Corrupted Files - Replacement Only

If you receive corrupted or damaged files that cannot be opened or used, please contact us immediately:

• Etsy Purchases (Live Drops): Contact through Etsy's messaging system
• Direct Purchases (Music/Albums): Email gokamiart@gmail.com with your order details
• Vaulted Art: Contact us using the method provided during purchase

We will provide replacement files or technical assistance to resolve legitimate file corruption issues. This is not a refund - you will receive working copies of your purchased files.

6.3 Review Before Purchase

We strongly encourage you to:

• Carefully review all product descriptions, previews, and specifications before purchasing
• Ensure you understand what you are purchasing
• Verify file format compatibility with your devices
• Read our licensing terms to understand usage rights

Once purchased, your transaction is final.

7.1 Service "As Is"

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 No Guarantee

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• Results from using the Service will meet your expectations

7.3 File Quality

While we ensure all digital files are of professional quality, actual appearance may vary based on your display device, printer, or printing service. We are not responsible for color variations, printing quality, or reproduction accuracy.

7.4 Spiritual Content

GOKAMI artwork contains spiritual testimony and symbolism. While we share the inspiration and meaning behind our work, individual spiritual experiences and interpretations may vary. We make no guarantees about specific spiritual outcomes or experiences.

7.5 No Refunds

Remember: All sales are final. No refunds are issued for digital downloads. Please review carefully before purchasing.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOKAMI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

8.1 Maximum Liability

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to GOKAMI for the specific purchase in question.

8.2 Exceptions

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

9.1 Our Commitment

GOKAMI operates on a principle of minimal data collection. We heal souls, we don't collect them. We only gather the information absolutely necessary to complete your purchase and deliver your files.

9.2 What We Collect

When you make a purchase, we collect:

• Email address (for file delivery)
• Payment information (processed securely through third-party payment gateways)
• Purchase details (artwork purchased, transaction date, amount)

9.3 What We Don't Collect

• No account creation or password storage
• No behavioral tracking or profiling
• No marketing databases or email lists (unless you explicitly opt-in)
• No unnecessary personal information

9.4 Data Security

We use SSL encryption and secure payment gateways to protect your information. Payment processing is handled by trusted third-party processors (Etsy, PayPal, Stripe). We never store complete credit card information.

9.5 Data Retention

Transaction records are retained only as long as legally required for tax and accounting purposes. Email addresses used for delivery are not added to marketing lists without your explicit consent.

9.6 Third-Party Platforms

GOKAMI uses different platforms for different product types:

• Etsy (Live Drops): When you purchase through Etsy, their privacy policies and data handling practices apply in addition to ours.
• PayPal (Music/Albums): When you purchase through our direct payment system, PayPal's privacy policies apply to payment processing.
• Vaulted Art Requests: Inquiries and purchases handled directly with GOKAMI follow only our privacy practices.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
